- Licensing & Legal Notices: Contractors must be licensed. Under the Mechanics Lien Law, your property could be subject to a lien if subcontractors or suppliers aren’t paid—even if you paid your contractor.
- Work & Payments: If payment is delayed, the contractor can stop work and request payment for completed work plus 10% profit. Owners are responsible for protecting the site and materials if work is halted.
- Plans, Permits, and Utilities: Owner provides permits, utility access, drinking water, toilet facilities, and job site electricity unless otherwise stated.
- Changes & Extra Work: Any changes must be agreed upon in writing. Additional work or compliance changes are extra and will be billed accordingly.
- Termite & Rot Repairs: Not included unless specified as extra work.
- Debris Removal: Contractor will clean up and remove debris unless otherwise agreed.
- Insurance: Contractor carries worker’s comp for employees. Owner must insure others on-site.
- Property Protection: Owner is responsible for protecting personal items; contractor isn’t liable for damage.
- Guarantees: Workmanship is guaranteed for 30 days to 1 year; materials for 1 to 5 years depending on the invoice. Manufacturer warranties apply for certain items.
- Entire Agreement: This written contract is the full agreement. Any changes must be in writing.
- Disputes: Unresolved disputes will be handled through binding arbitration under AAA rules.
